Liability Waiver

HORSE FITTER PRO - LIABILITY WAIVER & RELEASE OF CLAIMS

This Liability Waiver and Release of Claims ("Waiver") is entered into between the undersigned Owner and Horse Fitter Pro ("HFP"), its officers, employees, agents, independent contractors, fitters, affiliates, and successors (collectively, "Releasors").

By signing this Waiver, the Owner acknowledges that they are voluntarily participating in horse fitting services provided through HFP and assumes all risks associated with such services.

SECTION 1: RISK ACKNOWLEDGMENT

2. VOLUNTARY PARTICIPATION The Owner confirms they are choosing to use HFP services voluntarily and understand they may decline any recommendation without penalty.

SECTION 2: LEGAL RELEASE & INDEMNIFICATION

3. RELEASE OF LIABILITY To the fullest extent permitted by law, the Owner hereby releases, waives, discharges, and covenants not to sue HFP and all Releasors from any and all claims, demands, causes of action, damages, losses, or expenses arising out of or related to: • Any injury, illness, disability, or death sustained by the horse, rider, or any other person • Any damage to property, tack, equipment, or vehicles • Any errors, omissions, or negligence in saddle fitting, pad recommendations, or diagnostic services • Any advice, recommendations, or opinions provided by HFP fitters • Any breach of contract, warranty, or guarantee (expressed or implied) • Any violation of federal, state, or local laws or regulations

4. ASSUMPTION OF RISK The Owner expressly assumes all risks associated with horse fitting services, including risks known and unknown, foreseeable and unforeseeable.

5. INDEMNIFICATION The Owner agrees to indemnify, defend, and hold harmless HFP and all Releasors from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: • The Owner's use of HFP services • Any injury or damage caused by the horse while under the Owner's control • Any misrepresentation of the horse's condition, training level, or intended use • Failure to follow fitter recommendations or instructions

SECTION 3: SPECIFIC DISCLAIMERS

7. FITNESS FOR PURPOSE DISCLAIMER HFP provides saddle fitting and pad recommendations based on professional expertise, but makes NO WARRANTIES, EXPRESS OR IMPLIED, regarding: • The suitability of any recommended saddle or pad for the horse's specific needs • Performance improvements resulting from fitting services • Long-term comfort or health outcomes • Compatibility with any riding discipline or activity

8. LIMITATION OF LIABILITY In no event shall HFP be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility of such damages. Total liability shall not exceed the amount paid for the specific fitting service.

SECTION 4: ADDITIONAL TERMS

9. MEDICAL TREATMENT AUTHORIZATION In case of emergency involving the horse during a fitting session, the Owner authorizes HFP fitters to seek necessary veterinary care. The Owner accepts full financial responsibility for all veterinary costs incurred.

10. INSURANCE REQUIREMENT The Owner acknowledges they are responsible for maintaining adequate insurance coverage for their horse, including mortality, medical, and liability insurance. HFP does not provide insurance coverage for horses or riders.

11. GOVERNING LAW This Waiver shall be governed by and construed in accordance with the laws of the state where the fitting service is performed, without regard to conflict of law principles.

12. SEVERABILITY If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. ENTIRE AGREEMENT This Waiver constitutes the entire agreement between the parties and supersedes all prior discussions, agreements, or understandings, whether written or oral.
